This Privacy Policy describes how LBH Skincare, LLC (we, us, our) collects, uses, and discloses your Personal Information when you visit or make a purchase from www.lbhskincare.com or our mobile application (collectively, the “Site”).

We collect information relating to an identified or identifiable individual (“Personal Information”) when you visit the Site. This information includes certain information about your device, your interaction with the lbhskincare.com, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. See the list below for more information about what Personal Information we collect and why.

 

  • Device information

    • Purpose of collection: to load lbhskincare.com accurately for you, and to perform analytics on lbhskincare.com usage to optimize our Site.

    • Source of collection: Collected automatically when you access lbhskincare.com using cookies, log files, web beacons, tags, or pixels. 

    • Disclosure for a business purpose: shared with Shopify and Meta for marketing purposes and Google for analytics of our website traffic and user browsing experience and marketing purposes. 

    • Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with lbhskincare.com.

  • Order information

    • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

    • Source of collection: collected from you.

    • Disclosure for a business purpose: shared with our processor Shopify for the purposes listed above.

    • Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, email address, mailing address, and phone number).

 

Minors

Lbhskincare.com is not intended for individuals under the age of 13. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address above to request deletion.

 

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.


Sales of Personal Information  

In the last 12 months, we have not sold Personal Information to any third parties that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.  


Behavioral Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

Using Personal Information

We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

Individuals who use our Site or service(s) (e.g. customers, generated leads, prospective employees, employees, or general consumers) outside of the United States should understand that we may collect, process, and store Personal Information in the United States and other countries in which we or our affiliates or service providers maintain facilities. As explained above, we process Personal Information in various ways depending upon data subjects’ use of our sites and/or services. We process Personal Information on the following legal bases: consent; as necessary to perform our agreement to provide services or other applicable agreements; as necessary for compliance with a legal obligation to which we are subject; or as necessary for the legitimate interests of us and our customers and partners to engage in direct marketing and sales, and our legitimate interests in organizing and making available generated leads.

 

Personal Information we collect may be transferred to, and stored and processed in, the United States or any other country in which we or our affiliates or service providers maintain facilities. Per the applicable requirements of the GDPR, we will ensure that transfers of Personal Information to a third country or an international organization are subject to appropriate safeguards as described in Article 46 of the GDPR, such as the UK or EU Standard Contractual Clauses, as applicable.

Furthermore, we have committed to refer unresolved privacy complaints under the Privacy Shield Principles to JAMS (Judicial Arbitration & Mediation Services), an independent alternative dispute resolution provider located in the United States and recognized for this purpose by the U.S. Department of Commerce. Please note that we are not required to:

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your Personal Information from our records; and

  • Direct any Service Providers to delete your Personal Information from their records.


Please note that we may not delete your Personal Information if it is necessary to:

  • Complete the transaction for which the Personal Information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for that activity;

  • Debug to identify and repair errors that impair existing intended functionality;

  • Exercise free speech, ensure the right of another person to exercise his or her right of free speech, or exercise another right provided for by law;

  • Comply with the California Electronic Communications Privacy Act or other state or federal law;

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;

  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;

  • Comply with an existing legal obligation; or 

  • Otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Right to Fair Treatment and Protection Against Discrimination

You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA and certain other privacy and data protection laws, as applicable.  This means we cannot, among other things:

  • Deny goods or services to you;

  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;

  • Provide a different level or quality of goods or services to you; or

  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.


Please note that we may charge a different price or rate or provide a different level or quality of service to you, if that difference is reasonably related to the value provided to our business by your Personal Information.


Also, please note that our ability to serve you may be limited or made impossible if the removal or disclosure limitations of your Personal Information set by you limits our ability to serve you or makes our ability to serve you impossible.  

Targeted advertising

You have the right to opt out of the processing of Personal Information for the purposes of targeted advertising.

The Sale of Personal Information

You have the right to opt out of the sale of your Personal Information.

Profiling

You have the right to opt out of profiling in furtherance of a decision that produces a legal or similarly significant effect concerning the consumer.

Please note that you may only make a CCPA-related data access or data portability disclosure request twice within a 12-month period.

 

Please note that GDPR-related requests to exercise any rights under the GDPR can also be made to the Article 27 Representative as explained above. 


If you choose to contact us, you will need to provide us with:


  • Enough information to identify you (e.g., your full name, address, and email address);

  • Proof of your identity and address (e.g., a copy of your driving license or passport and a recent utility or credit card bill); and

  • A description of what right you want to exercise and the information to which your request relates.


Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.  We are not obligated to make a data access or data portability disclosures if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person’s behalf.

Some jurisdictions permit the Consumer to appeal an action taken by the Controller regarding the consumer's request to exercise the rights listed above. If applicable, you may appeal the action by submitting a written document titled “Appeal” to us at concierge@lbhskincre.com that sets forth all facts and authority that are relevant and the specific relief you are requesting.


How to File a Complaint

We hope that we can resolve any query or concern you raise about our use of your information.

Many laws also give you the right to lodge a complaint with a supervisory authority.  For example, in the European Union (or EEA), you can lodge a complaint in the state where you work, normally live, or where any alleged infringement of data protection laws occurred.  Similarly, under the CCPA in California, you can lodge a complaint with the California Attorney General’s office.  If you need help finding the proper authority to lodge a complaint, please contact us at the email listed above, and we will respond with the appropriate authority, if applicable, within 30 days.

E-mail and Text Communications

We may use your personal information to send you updates or communications by email, text message, telephone or post about our services, including exclusive offers, promotions or new services.

We have a legitimate interest in processing your personal information for promotional purposes.  This means we do not usually need your consent to send you promotional communications.  However, where consent is needed, we will ask for this consent separately and clearly.

You have the right to opt out of receiving promotional communications at any time by contacting by using the “unsubscribe” link in emails or “STOP” number in texts.

We may ask you to confirm or update your marketing preferences if you instruct us to provide further services in the future, or if there are changes in the law, regulation, or the structure of our business.


Changes to this Privacy Policy

We may change this Policy from time to time.  We will notify employment applicants, employees, customers, and generate leads of changes or updates to this Policy that reflect a substantial or material change to this Policy.  We will send such notifications before the changes to this Policy take effect.
